287(g) In Florida

ICE 287(g) agreements are formal partnerships between U.S. Immigration and Customs Enforcement (ICE) and state/local law enforcement agencies. These are authorized by Section 287(g) of the Immigration and Nationality Act. 287(g) allowing designated local officers to perform certain federal immigration enforcement functions, primarily to identify and process immigrants under ICE oversight, often through jail or task force models.

In Florida, every single county in the state has signed a 287(g) agreement with ICE. So has our State Highway Patrol and the vast majority of local law enforcement agencies (For example the link in the footnote will take you to the Tampa Police Department 287(g) Agreement). 

Because of this “ICE” presence is much muddier here. Every member of law enforcement is effectively a potential ICE agent in Florida. 

While it is likely that in the coming months we will see a more visible ICE presence in central Florida, it is possible that due to the prevalence of 287(g) we will not see a heavily armed militarized presence like we are witnessing in Chicago and Minneapolis. This does not reduce the risk of deportation to our neighbors, it increases it as the potential for deportation can now come from many different agencies.
